I used to wonder whether copyright infringement lawsuits like the thousands of Strike 3 Holdings lawsuits filed each year (or the hundreds each month) would ever stop. Below are reasons why I do not think the Strike 3 Holdings Lawsuit Settlement Scheme will ever end:

REASON #1: To sue and obtain a settlement is much cheaper than to spend that same money to obtain customers on their subscription-based adult film websites.

Let’s start with a bit of sarcasm. It is probably too much to ask them to return to the traditional business model of selling $100/year subscriptions to their adult film websites… not when they could make $10,000+ in settlement per person they sue.

Quick Logic — if you understand this, you’ll understand why they keep suing people.

Strike 3 Holdings, LLC can either spend their money trying to get customers on their adult film websites, or they can spend that same money suing ISP account holders who might have downloaded their copyrighted videos illegally using bittorrent in return for a windfall settlement payment.

  • $100/year subscription for one person;
  • $10,000+ Strike 3 Settlement Amount for one lawsuit…
  • CONCLUSION: $10,000/lawsuit vs. $100/year subscription is the equivalent of them selling 100 SUBSCRIBERS PURCHASING ANNUAL SUBSCRIPTIONS FOR ONE YEAR. How much would it cost them in advertising dollars to gain 100 subscribers? Or, they could pay $400 and file one Strike 3 Holdings lawsuit against ONE ISP account holder in return for one rewarding settlement payment.

As you can clearly see, it is cheaper to just sue downloaders rather than to try to make a profit the traditional way (trying to sell their subscription-based adult film services).

REASON #2: The settlement money they receive is a VERY PROFITABLE return for their “investment” (the filing fee they pay to file each lawsuit).

You must understand that it is simply TOO PROFITABLE for someone like Strike 3 Holdings LLC to file a lawsuit against an accused “John Doe Subscriber assigned IP address” as Strike 3 Holdings lawsuits often do. I am saying this again — STRIKE 3 HOLDINGS ODDS OF SUCCESS ARE HIGH BECAUSE BECAUSE THEY SUE DOWNLOADERS WHO LIKELY DOWNLOADED THEIR COPYRIGHTED TITLES.

Strike 3 Holdings Lawsuits are not filed until they have accumulated enough “damages” to ask for a large settlement which is multiplied by how many titles they believe you downloaded.

REASON #4: Because most Strike 3 Holdings Lawsuits settle out of court (and those that do not settle do not go to trial).

It would be a terrible hinderance to the Strike 3 Holdings lawsuit strategy if each and every accused defendant proceeded with litigation and eventually trial, even if they did the downloading of Strike 3 Holdings’ copyrighted videos.

Why? Strike 3 Holdings Lawsuits really are an out-of-court settlement scheme. They have a limited number of attorneys compared to the hundreds of lawsuits that are filed every single month.

However, let’s be real. Think of the prisoner’s dilemma. Nobody wants to be the one person who takes their case to trial. These lawsuits are REAL copyright infringement lawsuits filed with the full force and enforcement of the federal courts.

A $150,000 judgement will destroy anyone’s financial future, and this is enough of a deterrent to prevent each and every person from proceeding with litigation.

Even if a small handful of you retain me to litigate your cases — even if you did the downloads — it’s terrible for me to say this, but for the same price you would have paid me to take you through the pre-trial stages of litigating this case, you probably could have settled the claims against you for less money.

This is why I personally find these cases as evil (in a morally “good vs. evil” kind of way). The little guy has no choice except to resolve the claims out of court [if he did the downloads], or he is at the mercy of the plaintiff attorneys who will decide how far into the lawsuit they want to push him without him being able to fight back (or to pay an attorney to represent him to fight back).

What if I did not download the Strike 3 Holdings videos?

This is only if the accused defendant actually did the downloads. If he did not do the downloads, then the process of being found not guilty in these lawsuits is VERY EASY (and I could explain them to you).

Simply put, it is not your job to prove that you DID NOT download a particular video. It is THEIR JOB to prove that you did. The Strike 3 Holdings Lawsuits do this with your testimony at the deposition under oath (e.g., “sitting in front of a court reporter and answering their questions.”)

Enlisting the help of politicians and federal judges.

In sum, until some politician gets involved and stops these bittorrent-based copyright infringement lawsuits (or, call them “piracy” lawsuits or whatever), these lawsuits will continue because it is too profitable for the copyright holder to file these lawsuit and solicit settlements in return for not proceeding with litigation and eventually trial.

We have been successful over the years in changing the minds of federal judges one at a time — see our “policy letter” that we used to send to judges — and we have been successful in showing up in court and explaining that the copyright holder has no interest or ability to proceed with this case, and they are only using this lawsuit to force a settlement from the defendant — but this is a long and tedious road.

Judges own their own courtrooms, and they allow these cases to proceed. Some don’t — many don’t — but as soon as you receive an ISP Subpoena Notification Letter in the mail that you were implicated in a copyright infringement lawsuit against you, your judge has let the case proceed.

REASON #5: It is easier for a federal judge to let this case proceed rather than stop it because these cases settle out of court eventually with minimal effort.

I would hate to blame the judges for allowing the thousands of Strike 3 Holdings lawsuits to proceed, but really, with lawmakers which are not focused on copyright issues, for the last decade+, they have been the only gatekeepers who are legally able to stop these lawsuits. They have not.

I expect that since most Strike 3 Holdings lawsuits settle out of court (for “guilty” defendants), and the others are dismissed (e.g., after the deposition where the defendant did not do the downloads), these cases ALMOST NEVER GO TO TRIAL.

So as long as the judge rubber-stamps the case, gives the plaintiff freedom to do whatever they want to do, the case will be dismissed on its own in just a few months with little-to-no effort by the judge.

Problem solved for the judge. Problem solved for the copyright holder. The little guy gets financially destroyed in the process, and this is truly unfortunate.

FINAL REASON #6: Because we do not value our privacy, and we let ourselves be tracked and sued. Because we do not protect our internet traffic with a VPN.

HOW STRIKE 3 HOLDINGS LAWSUITS COULD GO AWAY FOREVER. USE A VPN.

Disclaimer: Understand that as an attorney, I am never advocating that anyone break the law. I am also not advocating that anyone download someone else’s copyrighted videos without a license. Stealing is wrong.

I think I have made my point with the headings. The final reason why Strike 3 Holdings lawsuits continue is because we do not value our personal privacy. We do not take steps to prevent others from snooping on our activities, and we do not protect our internet traffic with a VPN.

I have said this for years — IF everyone used a VPN to hide their IP address, then these cases would stop literally overnight. Most VPN providers are outside of the US, and they do not keep logs on their users’ activities.

If there is an ISP subpoena sent to a VPN provider about a particular account, and that VPN provider does not keep logs on who was assigned a particular IP address at a particular date and time, there can be NO CONNECTION between the downloader and the IP address he used when connecting to the VPN.

Hence, the copyright holder would never have been able to determine who was the ISP account subscriber assigned a particular IP address because it would have been the VPN’s protected IP address that connected to the Bittorrent swarm, not the IP address assigned to the subscriber by the ISP.

There is so much to say here, but this article is merely discussing the financial benefits to the Strike 3 Holdings LLC plaintiff to keep filing these Strike 3 Holdings lawsuits forever (and why I believe they will never stop suing downloaders).

The best I could do is suggest a way that there are no longer any downloaders to receive their lawsuits. If everyone used proper VPNs that protected the identities of their VPN subscribers, then these lawsuits would end overnight.

The reality, however, is that there will always be DNS leaks even when using a VPN (this is avoidable with a kill switch), and there will be individuals who do not value their privacy or individuals who think they will never get caught downloading copyrighted materials.

There will also be an endless supply of internet users who are simply unaware that it is wrong to download copyrighted videos without a license, so these Strike 3 Holdings lawsuits will likely continue forever.

IN CONCLUSION:

Obviously I would like to see these bittorrent-based copyright infringement “John Doe Subscriber” lawsuits disappear overnight. But the reality is that they are here to stay because there will always be an endless supply of potential defendants to sue for copyright infringement.

I would love for there to be a capitalist response to the piracy problem — perhaps make copyrighted content more readily available and for cheaper. Perhaps Strike 3 Holdings, LLC and similar companies need to find a more profitable way to sell access to their videos without having to resort to copyright infringement lawsuits, apparent extortion, and heavy-handed settlement demands.

For now, the Strike 3 Holdings lawsuits seem to be the most profitable method of enforcing their copyrights, so I expect that they will continue for the time being, and this is truly unfortunate.

    Suing a group of defendants in some obscure state or county court has been an effective way for Strike 3 Holdings Miami-Dade lawsuits to obtain the names and addresses of ISP subscribers who they believe downloaded their clients’ copyrighted adult film titles.

    I believe Strike 3 Holdings Miami-Dade lawsuits have made use of these state and county court filings in order to determine WHICH of these accused downloaders have deep pockets (who can pay a settlement), and who cannot pay a settlement.

    Those that can pay a settlement [and I must presume those they believe did the download, although I am doubtful if this is even a consideration anymore] will end up getting sued in their home state’s federal court in a copyright infringement lawsuit for $150,000 per instance of infringement, or they will settle out of court.

    Those that cannot pay a settlement — for example, those that are unemployed, or have declared bankruptcy, or through their research they have determined that they do not have money to pay a settlement will likely not be sued in a federal court. It would be a waste for Strike 3 Holdings LLC to pay another $400 (on top of the filing fee they already paid) to file a lawsuit when they know they will be unable to solicit a large settlement in return for that lawsuit.

    Strike 3 Holdings Miami-Dade lawsuits ignore the fact that state or county-based lawsuits are the IMPROPER court to file such a lawsuit.

    While these state-based and county-based lawsuits are improper — State Courts or County Courts are not the proper jurisdiction or venue to file these lawsuits. Copyright infringement lawsuits can ONLY be filed in a federal court.

    With this said, Strike 3 Holdings LLC have not stopped MISUSING state-based county courts and obscure state-based laws to obtain the names and addresses of the ISP account holders they believe downloaded their copyrighted titles.

    A favorite Strike 3 Holdings Miami-Dade lawsuits’ tactic is to use the “Bill of Discovery” laws in certain state and county courts. Any time you receive an ISP subpoena and the lawsuit is filed in the Miami-Dade County Court, this is a “Bill of Discovery” lawsuit; it is NOT YET a copyright infringement lawsuit.

    The obvious threat (and the fear tactics that some attorneys might try to use) is that if you do not settle the claims against you, they can and will sue you in the federal court in the state in which you live.

    But remember, I believe whether you get sued or not is probably based on whether Strike 3 Holdings LLC thinks you have enough money to pay a settlement.

However, other copyright trolls like Malibu Media LLC used to file these same type of “Bill of Discovery” cases both in the Miami-Dade County Court and the Maricopa County, Arizona county court just a few years ago.

    Even though filing in a state or county court is IMPROPER (a state or county court has no personal jurisdiction over the out-of-state defendants), the allure of state or county-based “Bill of Discovery” lawsuits still is too strong for them, because they are SO MUCH CHEAPER than the federal court lawsuits.

      Strike 3 Holdings, LLC filed roughly 160 copyright infringement lawsuits in federal courts (US District Courts) across the US in the last month (this time last year, they were filing on average 130+ cases each month). They appear to have focused their lawsuits on the US District Courts in the states of California, Connecticut, Florida, Michigan, New Jersey, New York, Pennsylvania, and Virginia. As often as it is useful, I will be listing the Strike Holdings cases which are filed in each state.

      Many of these defendants may have ALREADY been sued… in Miami-Dade County, Florida.

      What is interesting and noteworthy is that many of the John Doe Defendants sued in each of these cases may have already been defendants in their Strike 3 Miami-Dade County, Florida Bill of Discovery cases.

      The connection between Miami-Dade County, Florida and the US District Court (Federal Courts).

      The purpose of the Miami-Dade County, Florida Bill of Discovery cases were to reveal the identities of the accused defendants across the US… so that Strike 3 can determine whether they will name and serve these defendants in their home state’s federal courts.

      In other words, they ALREADY KNOW the identities of each of the accused account holders.

      What we see here in each of the new filings in the federal courts — they are suing them again as JOHN DOE DEFENDANTS. Did I emphasize that? AGAIN! These new defendants are not sued as “Jan Keller, Frank Samuels, or George Jackson” (I made these names up, sorry if you were actually one of the defendants), but STRIKE 3 HOLDINGS V. JOHN DOE SUBSCRIBER ASSIGNED IP ADDRESS

      In other words, they told each of the federal court judges that:

      “I don’t know who this person is, so I am suing them as a “John Doe placeholder-in-lieu-of-name” defendant. “Please judge, let me send a subpoena to their ISP to force the ISP to share the accused unknown defendant’s identity with me.”

      In practice, Strike 3 Holdings LLC is now sending a second subpoena to each defendant because each of these defendants have already received their first subpoena when they were accused John Doe defendants in the Florida Miami-Dade County, Florida Bill of Discovery case.

      So… round two (technically, round THREE since I did this article already in August of 2020, but the circumstances are still the same).

      MIAMI DADE COUNTY COURT LIST OF STRIKE 3 HOLDINGS CASES:

      The list of open Miami-Dade, Florida Bill of Discovery cases has been dwindling in recent months (and this is good — Strike 3 Holdings LLC should NOT have been filing copyright infringement lawsuits in STATE courts pretending that they were not copyright cases when they clearly were). The ONLY court in which a plaintiff should file a copyright infringement case is in a FEDERAL court.

      The Connection between the New Strike 3 Holdings, LLC Federal Court Case Filings, and the Miami-Dade County, Florida Bill of Discovery Filings.

      Today is 1/23/2022, and I am writing this article to allow you to demonstrate a point to yourself — that each of you who are now involved in a federal court case were once a Miami-Dade, Florida Bill of Discovery accused defendant.

      Other “Strike 3 Holdings by month” articles that I have written thus far are for the MARCH 2019, APRIL 2019, JANUARY 2020, JULY 2020, and then, AUGUST 2020.       In the Miami-Dade County Court, Strike 3 Holdings devised a way to unmask the identities of THOUSANDS of defendants without needing to sue each defendant in Federal Court.       *NOTES TO SELF: There are TWO IMPORTANT reasons why Strike 3 Holdings, LLC is putting so much money into filing lawsuits in New Jersey:

      1) Strike 3 Holdings, LLC almost lost New Jersey as a state in which they would be allowed by the federal court to sue defendants (for lawyers, it was bad case law). For a short while, judges stood up to Strike 3 Holdings, LLC and stopped them from being allowed to send subpoenas to ISPs to force the ISPs to hand over the subscriber information to them.

      Apparently Strike 3 won that battle, so now they are taking advantage of that “WIN” and suing many defendants in New Jersey.

      2) The plaintiff attorney for each of these New Jersey cases is John Atkin of the Atkin Firm, LLC. There is a history WHY John Atkin is important to New Jersey, and that history is uncovered by understanding WHAT HAPPENED with the shake-up of attorneys last year.

        Strike 3 Holdings, LLC filed roughly 120 copyright infringement lawsuits in federal courts (US District Courts) across the US since my last article last month (this time last year, they were filing on average 100+ cases each month). They appear to have focused their lawsuits on the US District Courts in the states of California, Connecticut, Maryland, New Jersey, New York, Pennsylvania, and Virginia. As often as it is useful, I will be listing the Strike Holdings cases which are filed in each state.

        Most of these defendants were ALREADY sued… in Miami-Dade County, Florida.

        What is interesting and noteworthy is that many (if not all) of the John Doe Defendants sued in each of these cases were once defendants in their Strike 3 Miami-Dade County, Florida Bill of Discovery cases.

        The connection between Miami-Dade County, Florida and the US District Court (Federal Courts).

        The purpose of the Miami-Dade County, Florida Bill of Discovery cases were to reveal the identities of the accused defendants across the US… so that Strike 3 can determine whether they will name and serve these defendants in their home state’s federal courts.

        In other words, they ALREADY KNOW the identities of each of the accused account holders.

        What we see here in each of the new filings in the federal courts — they are suing them again as JOHN DOE DEFENDANTS. Did I emphasize that? AGAIN! These new defendants are not sued as “Maude Parker, Sam Finnen, orJake Green” (I made these names up, sorry if you were actually one of the defendants), but STRIKE 3 HOLDINGS V. JOHN DOE SUBSCRIBER ASSIGNED IP ADDRESS

        In other words, they told each of the federal court judges that:

        “I don’t know who this person is, so I am suing them as a “John Doe placeholder-in-lieu-of-name” defendant. “Please judge, let me send a subpoena to their ISP to force the ISP to share the accused unknown defendant’s identity with me.”

        *NOTES TO SELF: There are TWO IMPORTANT reasons why Strike 3 Holdings, LLC is putting so much money into filing lawsuits in New Jersey:

        1) Strike 3 Holdings, LLC almost lost New Jersey as a state in which they would be allowed by the federal court to sue defendants (for lawyers, it was bad case law). For a short while, judges stood up to Strike 3 Holdings, LLC and stopped them from being allowed to send subpoenas to ISPs to force the ISPs to hand over the subscriber information to them.

        Apparently Strike 3 won that battle, so now they are taking advantage of that “WIN” and suing many defendants in New Jersey.

            New Jersey
            New Jersey Strike 3 Holdings cases are run by John Atkin of The Atkin Firm, LLC.

            John Atkin used to work for Fox Rothschild, LLP in New Jersey. John Atkin was the only one of the Strike 3 Holdings attorneys handling all of the New Jersey Strike 3 Holdings filings, however, at the time in which he was with Fox Rothschild, LLP, I did not get the sense that he had authority to negotiate the cases himself. Rather, it appeared as if he was local counsel filing cases for Lincoln Bandlow.

            That changed in/around May, 2019. As you have read above, in my observation, John Atkin overthrew Lincoln Bandlow’s authority and carved out autonomy for himself among the Strike 3 Holdings attorneys in the hierarchy. By May, 2019, he already left Fox Rothschild, LLP and started his own law firm. I learned about this when I started seeing “The Atkin Firm, LLC” on the cases in which I was representing clients rather than Fox Rothschild, LLP.

            I still think that Lincoln might still be the “boss” of the various Strike 3 Holdings attorneys across the US along with the Strike 3 Holdings, LLC cases, but it appears to me as if John Atkin is working on his own (maybe as a co-equal boss with Lincoln Bandlow and/or Jackie James), with sole authority and decision-making power over his cases.

            *NOTES TO SELF: There are TWO IMPORTANT reasons why Strike 3 Holdings, LLC is putting so much money into filing lawsuits in New Jersey:

            1) Strike 3 Holdings, LLC almost lost New Jersey as a state in which they would be allowed by the federal court to sue defendants (for lawyers, it was bad case law). For a short while, judges stood up to Strike 3 Holdings, LLC and stopped them from being allowed to send subpoenas to ISPs to force the ISPs to hand over the subscriber information to them.

            Apparently Strike 3 won that battle, so now they are taking advantage of that “WIN” and suing many defendants in New Jersey.

            2) The plaintiff attorney for each of these New Jersey cases is John Atkin of the Atkin Firm, LLC. There is a history WHY John Atkin is important to New Jersey, and that history is uncovered by understanding WHAT HAPPENED with the shake-up of attorneys last year.

            New York
            New York Strike 3 Holdings cases are run by Jacqueline M. James (Jackie James) of The James Law Firm, PLLC.

            Just as I described in the “Connecticut” section, Jackie James used to represent Malibu Media, LLC, another prolific copyright troll. Jackie was in charge of all of the Malibu Media, LLC cases filed in the New York federal courts.

            I consider Jacqueline James to be a “boss” when categorizing her among the Strike 3 Holdings attorneys in their hierarchy.

            Jackie James at one point was an important attorney filing many cases for Malibu Media, LLC. She even stayed with them after there was a shake-up of Malibu Media, LLC attorneys, but then one day she stopped filing for them.

            It is important to note that Jacqueline James stopped representing Malibu Media, LLC because she dropped them as a client. She did not “swing from one branch to the next” by dropping one client in favor of a more profitable one. When she dropped Malibu Media, LLC as a client, she did not have another client.

            It was only later that [I presume] Strike 3 Holdings contacted her and asked her to file copyright infringement lawsuits on their behalf. Today, she appears to have independent authority and control of her cases, and she is in charge of the Strike 3 Holdings federal court lawsuits filed in New York and more recently, in Connecticut.

            When negotiating cases, Jacqueline James is known to be a difficult negotiator, but she is also fair. Be prepared to support everything you say with facts and if needed, documentation. Jackie James is the kind of attorney who does not simply take statements at face value, but she asks questions and follow-up questions… often which lead to uncomfortable conversations. Again, however, she is not known to gouge on settlement prices, but she is a tough in her approach.

However, searching for her, I found that Jackie James actually listed her as an attorney under her law firm.             Pennsylvania Strike 3 Holdings cases are run by Jason M. Saruya of Clark Hill PLC.

            Jason Saruya of Clark Hill PLC is the name of the attorney who is showing up for the Strike 3 filings in Pennsylvania District Court.

            He works for Clark Hill PLC, and he works out of the Philadephia, PA office.

            There is not much information about Jason Saruya, but from what I understand, he is a younger attorney, and he is probably working with Elsy Velasquez as his superior, as Elsy Velasquez was the attorney from Clark Hill PLC that took over the Strike 3 Holdings, LLC Maryland cases after the shake-up of their attorneys.

            Virginia Strike 3 Holdings cases are run by Dawn Marie Sciarrino of Sciarrino & Shubert, PLLC (more recently, I have found that she is working for Jacqueline James, the Strike 3 Holdings attorney for the NY/CT region).

            Dawn Marie Sciarrino is the name of the attorney who is showing up for the Strike 3 filings in the Virginia federal court filings.

            MY ORIGINAL WRITE-UP ON DAWN:
            Dawn Marie appears to be a partner in her law firm, and she works out of Centreville, VA.

            There is not much information about Dawn Marie Sciarrino (even their https://www.sciarrino.com website was down when I tried to reach it).

            From what I understand, she has been practicing as an attorney for many years. Her first bar was in New York in 1991, and she has represented clients before the U.S. Court of Appeals for the Fourth Circuit and for the District of Columbia Circut.

            What I do not understand is… [with her background, both educational and vocational] why in the world would she take Strike 3 Holdings, LLC as a client? This makes no sense to me.

            UPDATED INFORMATION:
            Doing further research, I was very surprised to see that Dawn Sciarrino was listed as an attorney in Jackie James’ website.

            Understanding Jackie James’ background and her experience, the connection between Jackie and Dawn became clear. They know each other. It was likely Jackie who suggested that Dawn take the Virginia cases because Strike 3 Holdings, LLC needed an attorney to file lawsuits in the Virginia federal courts against those Miami-Dade Strike 3 Holdings defendants who did not settle the claims against them.

            Texas Strike 3 Holdings cases are run by either:

            As of January, 2022, I have not seen many new cases filed in the various Texas District courts, however, I *have* seen a LOT of activity by Forrest Matthew Seger, III on his cases from 2021.
